LILYPIE.COM WISHLIST AGREEMENT

Terms Of Use The following are the terms and conditions for use of the Lilypie.com Wishlist. Please read them carefully. By using or accessing the Wishlist, you agree to these terms. You may not use the Wishlist if you do not agree to these terms of use.

User Registration To use the Wishlist, you must first create a free Lilypie.com account and are subject to the terms and conditions of the Lilypie.com website. The Wishlist is set up as a checklist to help you, your family and friends keep track of the things you need for your baby and for no other reason.

Privacy Policy If you create a Wishlist through Lilypie.com, you must provide your name, e-mail address and a password. All information is subject to the terms of our Privacy Policy.

No Spam, Damages Lilypie.com will immediately terminate any account of any person that it believes, in its sole discretion, is using the Wishlist in connection with any spam or other unsolicited bulk e-mail or using the Wishlist to harass or to send unwanted communications. In such instance, Lilypie.com shall have the right to an injunction and to seek monetary damages.

Indemnification You agree to indemnify Lilypie.com, its parents, affiliates, directors, and employees for any claim, including payment of reasonable attorney’s fees, asserted by any third party arising from any misuse of the Wishlist by you.

Unauthorized Use By Third Parties Lilypie.com shall not be liable or responsible for misuse by third parties of information that you or other users choose to publish on our web site, including, your name, mailing address, e-mail address, other personal information and product preferences.

Wishlist agreement changes This Wishlist agreement was last changed on August 21, 2005. We may change, modify, add or remove portions of this Wishlist agreement at any time, and any changes will become effective immediately upon being posted unless we tell you otherwise.

We make no warranty. We provide the Lilypie wishlist "as-is," "with all faults" and "as available." Lilypie gives no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws that this contract cannot change. To the extent permitted by law, we exclude the implied warranties of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement.

Changes to Lilypie wishlist; Our Cancellation of Access to Lilypie wishlist We may change the Lilypie wishlist or delete features at any time and for any reason. We may cancel or suspend your access to the Lilypie wishlist at any time. Our cancellation or suspension may be without cause and/or without notice. Upon such cancellation, your right to access or use the Lilypie wishlist stops right away. Once your access to the Lilypie wishlist is cancelled or suspended, any data you have stored on the Lilypie wishlist may not be retrieved later. We may cancel or suspend your access to the Lilypie wishlist for inactivity, which we define as failing to sign in to the Lilypie wishlist for an extended period, as determined by us.
